Working with a property management company from the start of an eviction has its advantages. We learn to know the case and the people involved from the beginning. Recently I was contacted by a property manager that was in the process of evicting a tenant for failing to pay rent. This case has frustrated the property management company as well as the owner of the property, due to how difficult the tenant was being with them. The made several offers to assist the tenant with relocation and every attempt went ignored. We began the process by serving a 14 day notice to quit upon the tenant and the tenant failed to respond or pay the past due rent. This forced the homeowner to file summary process with the local court. After giving proper service the tenant failed to appear in court on the scheduled date. The home owner received judgment as well as an execution for posession. Our office immediately posted a 48 hour notice to vacate at which time the tenant rushed into court to ask the court for an emergency stay from being evicted. By working with the property management company we were ready for this and had proper documentation to provide to the court. This morning the court heard the emergency hearing and found through credible evidence that the emergency stay was denied and that the physical eviction was to be carried out. THIS IS A HUGE WIN FOR THE LANDLORD! he is able to remove a tenant and regain possession of the property and clean it up to get a new tenant to occupy without further losing rental income or the hassle of a difficult tenant.
