What is a Capias Warrant?
In the common law system of the United States, a Capias warrant is essentially an order to arrest and detain an individual for the purpose of guaranteeing a court appearance. The Latin term Capias translates into English as, for the taking of, but it is not commonly associated with the seizure of property or the search of premises. A Capias warrant should be considered a writ of arrest.
Physical Arrest
The Defendant is physically arrested/apprehended, transported to the respective Court. Our Officers will remain with you and the Defendant until the Court orders their release or a resolution of case. The cost of the Physical Arrest is the responsibility of the Plaintiff at first but the Courts may assess those costs upon the Defendant.
Our office does not require any upfront fees for a Capias Arrest. For your convenience all costs and fees are required to be paid at the time of the court appearance or within 7 days after if an account is established.
Voluntary Surrender
This process requires an up-front cost for to the Plaintiff, which can be requested to the court to be added to the judgment making the Defendant reimburse the Plaintiff for this expense. A Voluntary Surrender through our notification process (either Mailing or Leaving a copy at the last and usual address of the Defendant) would allow the Defendant the opportunity to address the matter amicably, without the need of being physically arrested. The advantage of this is allowing all parties to schedule the appearance around the Plaintiffs or Attorney's normal court schedule. A Disadvantage is the fact that the Defendant knows about the situation and if he/she is avoiding this matter he/she will take more precautions to be apprehended if a physical arrest is required.
